Navigating the Complexities of EB-5 Investment for Iranian Nationals

The world of EB-5 investment is not without its challenges, particularly for Iranian nationals seeking to participate in this lucrative program. The strained relationship between Iran and the United States over the past four decades has created a unique set of obstacles that must be carefully navigated by both investors and Regional Centers.

Historically, the Office of Foreign Asset Control (OFAC) imposed stringent restrictions on Iranian money transfers due to international sanctions. U.S. entities receiving funds from Iran were required to obtain a special OFAC License, making the process arduous and time-consuming. However, since 2012, exemptions have been made for EB-5 and E-2 investments, easing some of the burdens faced by Iranian investors.

Nevertheless, the sanctions have left a void in the infrastructure necessary for direct bank transfers from Iran to the United States. All Iranian banks remain on OFAC's Specially Designated List (SDL), further complicating the transfer of funds. However, there are alternative methods available, such as utilizing Sarrafis, or exchange houses, to facilitate the movement of money out of Iran. While this approach may fall into a legal grey area, OFAC has been known to grant exceptions for certain investments. It is important to note, however, that USCIS, responsible for adjudicating EB-5 files, often imposes additional restrictions beyond what OFAC prescribes.

Despite these challenges, our law firm has achieved remarkable success in assisting Iranian investors with their EB-5 cases. Our meticulous vetting process for potential investors, coupled with a robust network for fund transportation, has proven instrumental in overcoming the complexities associated with Iranian EB-5 investments.
