USCIS Exempts Biometric Services for I-539 Applicants

On September 25th, 2023, USCIS announced a significant exemption. The $85 biometric services fee will no longer apply to Form I-539 applicants who submitted their applications on or after October 1st, 2023. USCIS assures that most applicants will not require biometric appointments, and only a select few will be scheduled if deemed necessary for their case. If your application is postmarked on or after October 1st, you will not be charged the Biometric Services Fee for your I-539.

Applicants who filed prior to October 1st may still be scheduled for a biometric appointment and are advised to attend if required. If you mistakenly submitted the fee separately from your filing, USCIS will return the fee to you. If you authorized a credit card transaction, only the application fee will be charged. This move is part of USCIS’s ongoing effort to eliminate the biometric requirement from the Form I-539 process altogether.
